01Acceptance of these terms
These Terms of Use govern your access to and use of the website operated by The Craft Media (“we”, “us”). By using the site you agree to them. If you don't agree, please don't use the site.
Any services we provide to clients are governed by a separate written agreement. If that agreement conflicts with these terms, the agreement wins.
02Using the site
You're welcome to browse, read and share our content for your own business or personal purposes. You agree not to:
- Break the law or infringe anyone's rights while using the site.
- Attempt to gain unauthorised access to, probe or disrupt the site, its servers or its security measures.
- Submit spam, automated or bulk enquiries, malware, or false information through our forms or chat.
- Scrape or copy the site at a scale that burdens our infrastructure, or to build a competing service.
We may restrict or block access for anyone who breaches these terms.
03Intellectual property
The site and its content — text, design, graphics, code, logos and the The Craft Media name — are owned by us or our licensors and protected by copyright and trademark law. Quoting short extracts with attribution and a link is fine; anything else needs our written permission.
Client names, logos and case studies are shown with permission and remain the property of their respective owners. Ownership of work we create for clients is set out in each client agreement.
04Enquiries, quotes & submissions
Information on this site, including service descriptions, timelines and example pricing, is general and does not form an offer. A binding engagement only exists once both parties sign a written agreement.
When you send us a message, you allow us to use its contents to reply and to prepare a proposal, as described in our Privacy Policy. Please don't share confidential information until we have signed an NDA — we're happy to do so on request.
05Third-party links
The site may link to websites and services we don't control, such as social networks or WhatsApp. We aren't responsible for their content, policies or practices, and a link does not imply endorsement.
06No warranties
We work hard to keep the site accurate and available, but it is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Articles and insights are for general information only and are not professional advice for your specific situation.
07Limitation of liability
To the fullest extent permitted by law, The Craft Media will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of — or inability to use — the site.
Our total liability for any claim relating to the site is limited to one hundred US dollars (US$100). Nothing in these terms limits liability that cannot be limited by law.
08Indemnity
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the site or breach of these terms.
09Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
10Changes to these terms
We may update these terms from time to time. The “Last updated” date above shows the current version, and continued use of the site after changes means you accept them.
